Overview
The 1997 constitutional reform Decreto and its 1998 statutory implementation together constitute the single most consequential restructuring of Mexican nationality law since the 1917 CPEUM itself. The Decreto reformando los Arts 30, 32, and 37 CPEUM was published in the Diario Oficial de la Federación on 1997-03-20 — NOT on 1998-03-20, as.1, §5.2, and §17 originally asserted ( MX-: HIGH severity; the publication date is 1997-03-20; the EIF date is 1998-03-20 per Art Primero Transitorio, which mandated a one-year transition period to allow Mexicans abroad time to regularize their status before dual-nationality became operative). The single exception was CPEUM Art 37 C último párrafo, which entered into force on 1997-03-21 (next-day publication plus one calendar day), as it governed internal Congreso procedures not requiring the transition window.
The Decreto's operative substance reshaped three constitutional articles in coordination:
Art 30: Reformulated to acknowledge that Mexican nationals could acquire foreign nationalities without losing Mexican nationality — the core dual-nationality enabling provision. The 1997 text of Art 30 also began the structural shift toward the distinction between "mexicano por nacimiento" (Art 30 Apartado A) and "mexicano por naturalización" (Art 30 Apartado B) that the 2021 Gran Nación Transterritorial reform later built upon.
Art 32: Reformed to allow Congress and the states to reserve certain public offices for mexicanos por nacimiento who have not acquired another nationality — the constitutionally authorized carve-out from dual-nationality permissibility. This provision became the foundation for the SCJN Pleno AI cluster documented in MX-IND-05, which ultimately constrained Art 32's application to only those offices textually enumerated in the CPEUM.
Art 37: Restructured into three Apartados: A (establishing the absolute non-deprivation principle for mexicanos por nacimiento — "Ningún mexicano por nacimiento podrá ser privado de su nacionalidad"); B (governing loss of nationality for mexicanos por naturalización through enumerated grounds); and C (governing loss of Mexican citizenship, distinct from nationality). The three-Apartado structure that Art 37 acquired in 1997 remains operative today, subject only to the 2013 DOF 2013-09-30 reform to Apartado C.
The statutory implementation side is the Ley de Nacionalidad DOF 1998-01-23, which entered into force simultaneously with the constitutional reform on 1998-03-20. The 1998 Ley replaced the Ley de Nacionalidad 1993 (NOT the Ley 1934 directly — corrects this: the chain is 1993 → 1998, not 1934 → 1998). The 1998 Ley established the operational procedures for naturalization, the Art 16-19 recovery framework for those who had previously lost nationality, the SRE-DGAJ as sole competent authority, and the tariff structure for nationality acts.
The characterization as the "International Law Transition Trifecta" captures a three-part coordinated legal restructuring that no other T1+ cohort country executed simultaneously: (1) CPEUM constitutional reform DOF 1997-03-20 EIF 1998-03-20; (2) Ley de Nacionalidad 1998 DOF 1998-01-23 EIF 1998-03-20 (statutory implementation); and (3) MX denuncia of the 1933 Montevideo Convention on Nationality (OEA A-34) by Nota 1961 dated 1997-03-07, with denuncia effective 1998-03-07 — systematically removing the international-treaty prohibition on dual nationality that had governed Mexico since 1936 ratification, in parallel with removing the domestic constitutional prohibition.
