Overview
Mexico's Indigenous constitutional framework is the most comprehensive and multi-layered in the T1+ cohort. CPEUM Art 2, reformed comprehensively on DOF 2024-09-30 (EIF 2024-10-01), now recognizes Indigenous peoples and communities as "sujetos de derecho público con personalidad jurídica y patrimonio propio" — legal subjects of public law with their own legal personality and patrimony. This represents the 2024: the paradigm shift from a 2001 framework that recognized Indigenous peoples' rights "in the public interest" to a 2024 framework that grants them full legal personality as collective public-law entities.
