Citizenship in Mexico

Overview

The correct date is 1921-02-25. The first Mennonite migration from Manitoba arrived in 1922-03-01 — approximately one year after the privilegium was granted, during which the communities organized their departure from Canada.

The privilegium granted four key accommodations to the Mennonite communities:

  1. Military service exemption: Mennonites would not be required to serve in the Mexican military (Servicio Militar Nacional — Ley del SMN)
  2. Oath release: Mennonites would not be required to swear civil oaths that conflicted with their religious practice of affirmation rather than oath-swearing
  3. Religious freedom: Freedom to practice their Anabaptist faith without state interference
  4. School and community autonomy: Freedom to operate their own German-language schools (Plautdietsch-medium instruction) and administer their colony affairs internally under their traditional Ordnung (community rules)

How to apply

Not applicable as a dedicated nationality pathway. Mennonites access Mexican nationality through standard routes:

  • Born in Mexico: Automatically mexicanos por nacimiento via CPEUM Art 30 A I (MX-BTH-01)
  • Foreign-born Mennonites seeking naturalization: Must comply with Ley de Nacionalidad 1998 Art 19-21 (5-year general route, MX-NAT-01) or applicable accelerated route; privilegium does NOT provide a legal exemption from modern naturalization requirements

Filing authorities: Ejecutivo Federal (customary; historic privilegium). MX procedure (SPC): SRE-DGAJ + RENAPO + Registro Civil estatal operational; CPEUM Art 30/32/37 + Ley de Nacionalidad 1998 (última reforma DOF 2012-04-23) + Reglamento DOF 2009-06-17 framework; CURP Biométrica reform DOF 2025-07-16.

Legal basis

  • Primary instrument: Acuerdo Ejecutivo / privilegium granted by President Álvaro Obregón 1921-02-25 — NOT 1922 (HIGH MX-)

  • Modern nationality law: CPEUM Art 30 A I (jus soli — Mennonites born in Mexico are mexicanos por nacimiento); Ley de Nacionalidad 1998; Reglamento DOF 2009-06-17 (full application to Mennonite-origin foreign nationals seeking naturalization)

  • Military service: Ley del Servicio Militar Nacional (SMN) — privilegium provides customary exemption; this exemption is recognized in practice but has no modern statutory basis

  • Operative period: 1921-02-25 → present (customary; uncodified)

  • Authority: Ejecutivo Federal (customary — historic privilegium)

Example scenarios

  • nationality: NZ

    eligible via 2023 pathway

NZ citizen with 4y+ SCV qualifies for direct citizenship per Albanese 2023 reform.

  • Heinrich Friesen

eligible at birth with special framework

CPEUM Art 30 A I jus soli applies absolutely — Heinrich is mexicano por nacimiento regardless of Plautdietsch primary language or Mennonite communitarian isolation. The Privilegium Sui Generis Obregón 1921 (NOT 1922 ) provided customary religious-conscientious-objection accommodations (military service exemption, school autonomy) but does NOT alter underlying nationality acquisition. Heinrich has full Mexican nationality + civic rights. Practical issues: voting documentation requires Spanish-language CURP + INE Credencial — Heinrich may need bilingual support but cannot be denied federal nationality. sui-generis framework.
