Two conjunctive conditions must both be satisfied for first-generation citizenship by descent under s.3(1)(b): (1) the person was born outside Canada AFTER 14 February 1977 (births on or before that date fall under the pre-1977 historical chain, CA-HIS-01, not this route); and (2) at the time of the person's birth, at least one of the person's parents — other than a parent who only adopted the person — was a Canadian citizen. There is no requirement that the Canadian parent have lived in Canada, no residence or physical-presence test on the child, no language requirement, no knowledge test, and no oath for the first generation. The first-generation limit / substantial-connection test (s.3(3), the 1,095-day parental-presence rule) does NOT apply to the first generation born abroad: it is engaged only where the Canadian parent was themselves a citizen by descent or by certain grant categories AND was born outside Canada (i.e., the second-and-later generation). Where the Canadian parent was born in Canada, naturalised in Canada, or became a citizen by adoption-grant, the child of the first generation born abroad is a citizen without any presence test.

Citizenship by first-generation descent is conferred by operation of law, not by a decision-maker; no authority 'grants' it. IRCC (the Minister of Citizenship and Immigration, acting through citizenship officers at the Case Processing Centre) is the authority that CONFIRMS the status when it issues a citizenship certificate (proof of citizenship) under s.12 of the Citizenship Act. An officer's role on a proof application is to verify the s.3(1)(b) conditions are met (foreign birth after 14 February 1977, a citizen parent at the time of birth, a genetic parent-child link), not to exercise discretion. If a proof-of-citizenship application is refused (for example, because the officer is not satisfied a parent was a citizen at birth, or that the genetic link exists), the applicant may seek judicial review in the Federal Court (the 'Court' as defined in s.2(1)). The presumptive standard of review of an officer's citizenship determination is reasonableness per Canada (Minister of Citizenship and Immigration) v. Attorney General of Canada, 2023 ONSC 7152, struck the old absolute first-generation limit on Charter s.6 and s.15 grounds — though those cases concerned the limits on descent, not the core first-generation grant covered by this route. A practical alternative where proof is contested is to request a search of citizenship records or to resubmit with stronger evidence of the parent's citizenship status and the genetic link.
Exceptions & edge cases
Several edge cases recur in first-generation descent. (1) Assisted reproduction / no genetic link: per Kandola 2014 FCA 85, a child born abroad with no genetic connection to the Canadian parent did not acquire descent under s.3(1)(b) as then framed — a recurring issue for surrogacy and donor-conception arrangements; the genetic-link requirement is the controlling interpretation. (2) Child born abroad to two diplomat parents: unlike jus soli (s.3(2)), there is no diplomat carve-out from descent, so the child IS a citizen by descent if a parent was Canadian at birth. (3) Child of a Canadian parent who later lost or renounced citizenship: what matters is the parent's status AT the time of the child's birth, not afterward, because s.3(7)(h) fixes the child's citizenship from birth. (4) Birth registered late or born on a foreign vessel/aircraft: descent turns on the parent's citizenship, independent of where the birth is registered; the s.2(2)(a) deemed-Canada rule for Canadian-registered vessels/aircraft is a jus-soli concept, not descent. (5) One Canadian and one non-citizen parent: only one citizen parent is required. (6) Born just before 15 February 1977: such a person is on the pre-1977 historical chain (CA-HIS-01), not this route.
