Overview
§34 StbG provides forced retroactive Entziehung for §10/§58c-naturalized citizens who concealed existing foreign nationality at naturalization application OR acquired new foreign nationality within 6-year Verfristung WITHOUT §28 permission. Per VwGH Ra 2022/01/0314, the 6-year Verfristung runs from naturalization decree date.
Example scenarios
Primary applicant
§34 forced Entziehung if within 6-year Verfristung (decree-date anchor per VwGH Ra 2022/01/0314); if beyond Verfristung, §34 NOT invokable
Verfristung strict construction per VwGH Ra 2022/01/0314. Good-faith mistake (home-state non-de-registration) treated more leniently than concealment.
Edge case applicant
§58c-naturalized: §34 risk minimal due to §28 Abs 2 implicit exception; foreign-nat retention does not trigger §34
§58c restitution operates outside standard §28 application framework. §28 Abs 2 implicit exception protects §58c-acquirers from §34 retroactive revocation.
