Who qualifies

Applicable presumptions governed by §3(4): (1) §3(3)(a) — child born in Hungary to stateless parents with Hungarian lakóhely; (2) §3(3)(b) — child of unknown parentage found in Hungary (classic foundling; in force since 1879:L era); (3) §3(3)(c) — newborn born in Hungary to a foreign-citizenship mother who left the child at a healthcare institution directly after birth, adoptability determined by gyámhatóság within 6 weeks, child's nationality unknown (added by Act CXXVI/2025, in force 2025-12-23). HU-BTH-05 provides the procedural mechanics for all three.

Requirements

What establishes the presumption: factual satisfaction of the trigger conditions of the applicable §3(3) limb — no application is required. What rebuts the presumption (§3(4) mechanics): affirmative establishment of either (a) a foreign nationality of the child, OR (b) non-Hungarian parentage. Standard of proof: affirmative establishment — not balance of probabilities on an unverified assertion, but actual evidence (e.g. foreign birth certificate, DNA test confirming non-Hungarian parents, foreign travel document, consular confirmation of foreign nationality).

The operative rebuttal standard for ALL three §3(3) territorial presumptions is the opening clause 'Ellenkező bizonyításig magyar állampolgárnak kell tekinteni' — the child 'shall be regarded as a Hungarian citizen UNTIL THE CONTRARY IS PROVEN'. The presumption is therefore rebuttable by affirmative proof, not by mere doubt: it falls only where a foreign nationality or non-Hungarian parentage is positively established. For §3(1) origin questions feeding the rebuttal, §3 expressly directs application of the Polgári Törvénykönyv (Ptk.) rules on descent and on paternal/maternal status — so identification of a parent under Ptk. paternity/maternity rules is the principal mechanism by which a §3(3) presumption is later displaced.

How to apply

Presumption operates automatically at the factual trigger — no application required. Authority: citizenship-matters organ (állampolgársági ügyekben eljáró szerv — BFKH) adjudicates both confirmations and rebuttal proceedings. For §3(3)(c) specifically, the gyámhatóság also participates in the adoptability determination (trigger condition). Judicial review of §3(3) determinations lies at the Fővárosi Törvényszék within 30 days of notification — these are administrative/judicial determinations, NOT discretionary naturalisation grants, so the ECN Art 12 reservation does NOT bar review.

Timeline

Timeline: presumption arises automatically at the factual trigger (birth/finding). Birth registration in anyakönyv should occur as soon as practicable (statutory period in Hungary generally 60 days from birth). §3(3)(c) specific: the 6-week collection-declaration window runs from the hospital discharge/abandonment record date; the gyámhatóság adoptability determination triggers the §3(3)(c) presumption. Állampolgársági bizonyítvány from BFKH: no statutory maximum. Judicial review of a determination: 30-day window from notification.

Fees & cost

Illetékmentes (fee-free) since 2021-01-01 for all first-instance administrative citizenship procedures, including §3(3) presumption determinations and állampolgársági bizonyítvány. No citizenship stamp duty applies. Consular translation/apostille costs may apply for rebuttal evidence but are not statutory citizenship fees.

Legal basis

Nature of the presumption: the §3(3) presumptions are prima facie evidence of Hungarian citizenship, not absolute grants. They are rebuttable under §3(4) — the child loses the presumption only if a foreign nationality or non-Hungarian parentage is AFFIRMATIVELY ESTABLISHED. Mere uncertainty, lack of documents, or doubt is NOT sufficient. The burden of rebuttal falls on the party asserting non-Hungarian citizenship; the child (or the child's representative) does NOT bear the burden of proving Hungarian citizenship.

Competent authority

Competent authority: citizenship-matters organ (állampolgársági ügyekben eljáró szerv — BFKH). For §3(3)(c): gyámhatóság participates in adoptability determination (trigger, not citizenship). OIF: NOT competent for §3(3) presumption matters. Judicial review: Fővárosi Törvényszék (30 days). The President of the Republic is not involved in §3(3) determinations — the Presidential grant mechanism (§6(1)) applies only to naturalisation, not to statutory birth/foundling presumptions.

Exceptions & edge cases

Edge case — successful rebuttal creating statelessness: if a §3(3) presumption is rebutted but the child would become stateless (no alternative nationality), Hungary's 1961 Convention Art 1/Art 2 obligations create a conflict. In practice, rebuttal is complete only where an alternative nationality is identified — a 'successful' rebuttal that leaves the child stateless is inconsistent with Hungary's 1961 Convention obligations and the §9/E non-statelessness floor principle. The citizenship-matters organ should decline to register a rebuttal that would create statelessness without an alternative nationality being established.
