SI-MAR-001 Marriage to SI citizen Article 12(2) ZDRS (3 years marriage + 1 year SI residence). Bucket MAR. Substantially shortens residence vis-a-vis 10y SI-NAT-001 ordinary requirement. Who qualifies

Article 12(2) ZDRS marriage cumulative conditions: (1) Marriage to SI citizen registered for at least 3 years (continuous, not aggregated); (2) 1 year continuous SI residence; (3) Article 10(1) cross-referenced conditions points 1, 4, 6, 8, 9, 10 (release from prior citizenship NOT required; language NOT separately required at A2 floor though integration framework applies); (4) Bona fide marriage (no marriage of convenience); (5) No threat to public order/security. How to apply

Application is lodged with the Ministrstvo za notranje zadeve (Ministry of the Interior, MNZ) via any upravna enota (administrative unit) — jurisdiction is determined by the applicant's registered residence (SI-SRC-D-001). The MNZ application form for Article 12 family pathways and Article 10 ordinary naturalisation is the eUprava Vloga za sprejem v državljanstvo Republike Slovenije (redna naturalizacija) portal (SI-SRC-D-001), which the operative MNZ practice extends to spousal subroute applicants under Article 12(2). Application is accompanied by:

  1. Statement of marriage and continuous cohabitation — formal declaration as to the 3-year marriage continuity and the 1-year residence in Slovenia;
  2. Marriage documentation — Slovenian marriage certificate or apostilled / legalised foreign certificate per §3.1; updated certified copies (within 6 months of lodgement);
  3. Cohabitation evidence file — per §3.7 (joint registered residence, joint financial life, common-household narrative);
  4. Spouse's documentation — Slovenian citizen spouse's proof of citizenship (državljanstvo certificate or izpis iz matičnega registra);
  5. Article 10(1) evidentiary file — language certificate (osnovna raven A2-B1) from Center za slovenščino; foreign police-clearance certificate with apostille (within 3 months — SI-SRC-D-012); proof of regulated alien status (residence permit on family-reunion grounds or equivalent); proof of livelihood (income statements, employment record, household economic integration); tax-settlement attestation; assurance of release from prior citizenship under Article 14 ZDRS (SI-SRC-A-028), unless prior citizenship has already been renounced;

Legal basis

Article 12 of the Zakon o državljanstvu Republike Slovenije (ZDRS-UPB2, Uradni list RS 24/2007, SOP 2007-01-1211; čistopis from 2017-07-22 per ZDRS-E Ur.l. RS 40/2017) is a multi-paragraph article containing several discretionary fast-track subroutes to citizenship. SI-SRC-A-025 (Article 12(1)) governs Slovenian emigrants and descendants up to the fourth degree (the DSC pathway). SI-SRC-A-026 (Article 12 paragraphs 2-7) governs five additional special subroutes:

  • paragraph 2 — spouse of a Slovenian citizen (MAR bucket — this route SI-MAR-001);
  • paragraph 3 — former Slovenian citizen who lost citizenship via release or renunciation (RST bucket — separate route);

§2.2 The spousal subroute — Article 12(2)

Article 12(2) authorises the Government of the Republic of Slovenia (via the Ministrstvo za notranje zadeve, MNZ), upon application, to accept into Slovenian citizenship a spouse of a Slovenian citizen (zakonec slovenskega državljana) where the applicant cumulatively satisfies the following statutory conditions:
