Article 65 framework is constitutional but distinct from Article 64 autochthonous: NO guaranteed National Assembly seat; Romani recognised minority language but NOT co-official; MUNICIPAL-COUNCIL seats available in 20 municipalities (per ZRomS Article 5). Legal basis

The Roma framework rests on Article 65 of the Ustava Republike Slovenije (URS), Uradni list RS 33/1991 of 28-12-1991, promulgated 1991-12-23 (verbatim text anchored at ). The provision reads in substance: "Položaj in posebne pravice romske skupnosti, ki živi v Sloveniji, ureja zakon" — "The position and special rights of the Roma community living in Slovenia are regulated by statute" (statutory operationalisation at / ).

The article is structurally distinctive in the URS chapter on human rights and fundamental freedoms by virtue of three features (all foundational to the analysis at §3):

  • Single-sentence formulation. Unlike Article 64 (Italian/Hungarian autochthonous communities — 6 paragraphs detailing collective-rights package), Article 65 consists of a single clause delegating regulation to statute. The constitutional grammar is delegatory, not prescriptive.
  • No co-enumerated entitlements. Article 65 itself does not enumerate co-officialdom, parliamentary representation, consent-veto, cultural-educational autonomy, financing obligation, or self-government — each of which Article 64 enumerates expressly. Every operational right of the Roma community derives from the implementing statute (ZRomS-1) or other adjacent statutes, not from the Constitution directly.

For Roma applicants who do not meet the standard 10-year residence threshold of Article 10 ZDRS but qualify under an Article 12 sub-path (spouse / former-citizen / minor / stateless / refugee / born-in-SI), documented Roma-community engagement — through Roma Union membership, participation in municipal Roma-councillor activities, Roma-language educational or cultural work — may constitute evidence of integration relevant to the discretionary evaluation. The discretionary character of Article 12 means that MNZ + the Government Office for National Minorities + the Government Commission for the Protection of the Roma Community may consult one another on Roma-affiliated applications. Roma community status is a positively-weighted evidentiary factor but not a basis for waiver of cumulative conditions.
