SI-NAT-005 Naturalisation of adult person born in Slovenia residing continuously since birth (Article 12 paragraph 5 ZDRS). STANDARD route. Primary anchor paragraph 5 (peti odstavek per primary verification at pisrs.si + zakonodaja.com). Operational naturalisation outlet for SI-born long-term residents who failed jus sanguinis at birth. Structurally adjacent to IZBRISANI cluster (children born in SI to erased parents) and statelessness-mitigation Articles 8/9.
How to apply
- Application (vloga za sprejem v državljanstvo na podlagi 12. člena ZDRS, peti odstavek) is lodged at any upravna enota in Slovenia. Per the procedural-jurisdiction rule, the upravna enota of registered residence manages the case, but any upravna enota receives the application.
- Documentary requirements (consolidated from implementing regulation + administrative practice for cross-referenced Article 10(1) conditions):
- Birth certificate establishing birth on SI territory (rojstni list, issued by upravna enota of birth-locality);
- Continuous residence evidence from birth — documentary chain including:
- Civil-register entries (Centralni register prebivalstva / CRP records);
- Residence-permit history under ZTuj-2 (where applicable);
- School enrollment records (Slovenian primary, secondary, tertiary institutions);
- Healthcare-system enrollment records (ZZZS, Zavod za zdravstveno zavarovanje Slovenije);
- Employment records (where applicable, post-majority);
- Property-ownership / lease history;
- Family-residence documentation (parents' / siblings' / spouse's SI residence);
- Criminal-record certificates per Article 10(1)(6) — two distinct certificates: (a) potrdilo iz kazenske evidence from the Ministry of Justice (Slovenian criminal record); (b) potrdilo da oseba ni v kazenskem postopku from the competent okrajno/okrožno sodišče per Article 143a ZKP. Legal basis

"Pristojni organ lahko, če je to v skladu z nacionalnim interesom, po prostem preudarku sprejme v državljanstvo Republike Slovenije polnoletno osebo, rojeno na območju Republike Slovenije, če dejansko živi v Sloveniji od rojstva dalje in če izpolnjuje pogoje iz 6., 7., 8., 9. in 10. točke prvega odstavka 10. člena tega zakona."

"The competent authority may, if this is in accordance with the national interest, at its own discretion accept into the citizenship of the Republic of Slovenia an adult person born on the territory of the Republic of Slovenia, if the person actually lives in Slovenia from birth onwards and meets the conditions under points 6, 7, 8, 9, and 10 of the first paragraph of Article 10 of this Act."
The legislator additionally provided, in the immediately following paragraph 6 of Article 12, an explicit discretion-framework directive:
"Pri odločanju na podlagi prejšnjega odstavka lahko pristojni organ upošteva osebne, družinske, gospodarske, socialne in druge vezi, ki vežejo osebo na Republiko Slovenijo, ter posledice, ki bi jih povzročila zavrnitev prošnje za sprejem v državljanstvo Republike Slovenije."
