Overview

SI-RST-004 Pre-1991 women restoration (lost-by-marriage redress). historic loss-by-operation-of-law cohort distinct from SI-RST-001/002/003. STANDARD route. Three sub-cohorts: (A) Kingdom-of-Yugoslavia 1928 Citizenship Act cohort; (B) DFJ 1945 + FLRJ 1946 cohort; (C) SR Slovenia / SFRJ pre-1976 cohort. SFRY 1976 Article 22 (parental concord) removed prospective vehicle for new cases but did NOT retroactively restore historic cohort. SI ECN NON-PARTY.

Who qualifies

The applicant must establish:

  • Sub-cohort A / B / C identification: the historic woman whose loss is the source of the modern restoration claim must be identifiable as a woman who held Yugoslav citizenship at a historic date (Slovenian-republican-layer where the relevant predecessor regime included a republican layer; federal-layer-only for the 1928 Kingdom era) and who lost citizenship by operation of marriage to a foreign national under the 1928, 1945, 1946, or pre-1976 SFRY framework.
  • Historic loss event documentation: Archival evidence of the marriage event AND the loss event — typically extracted from Kingdom-of-Yugoslavia matični uradi records (for sub-cohort A), DFJ/FLRJ population-register entries (for sub-cohort B), and SR Slovenia / SFRJ federal records (for sub-cohort C).
  • Slovenian-republican identity: Evidence that the historic woman's underlying identity attached to the Slovenian republican layer (by birth in territorial Slovenia; by Slovenian parental descent; by prior registered residence in territorial Slovenia). This is the substantive anchor for the modern restoration claim under Article 39 ZDRS transitional bridge.

For the (now small) sub-population of historic women who are still alive and applying directly:

How to apply

  1. Pre-filing diligence. The applicant assembles:
  • (i) Documentary evidence of the historic woman's identity, marriage, and loss event: birth certificate (matični urad of birth); marriage certificate (matični urad of marriage event); citizenship records from Arhiv Republike Slovenije (ARS) for SR Slovenia 1976-era and earlier territorial Slovenia records; Arhiv Jugoslavije (Belgrade) for pre-1976 federal records; Kingdom-of-Yugoslavia matični uradi records (for sub-cohort A).
  • (ii) Slovenian-republican identity anchor: territorial Slovenia birth certificate; or Slovenian parental descent documentation; or prior registered residence in territorial Slovenia.
  • (iii) Lineage documentation (for second/third-generation applicants): birth certificates establishing the chain from the historic woman to the modern applicant; certified translations and apostille for foreign-issued documents.
  • (iv) Modern residence and standard supporting documents (Section 4 above): ZTuj-2 residence permit (where Article 12(2) residence-after-return is invoked); language certificate (centerslo.si Basic Level Exam A2 minimum within combined A2-B1 osnovna raven) or substitute documentation; livelihood documentation per X Ips 41/2021 and X Ips 37/2022 standards; clean-criminal-record certificate; settled-tax confirmation; foreign-state release or assurance where required.
  • (v) Application form for naturalisation under Article 12 ZDRS (or Article 13 for the extraordinary pathway), with the historic-cohort sub-path expressly identified.

Legal basis

Under successive pre-1991 Yugoslav citizenship regimes, women who married foreign nationals could lose their underlying Yugoslav citizenship (and, by republican incorporation, their Slovenian republican-citizenship layer) by operation of law. The historic loss pattern tracks three distinct statutory eras:

Era (i) — Kingdom of Yugoslavia Citizenship Act 1928 (Zakon o državljanstvu Kraljevine Srbov, Hrvatov in Slovencev / Kraljevine Jugoslavije). Promulgated 21-10-1928, effective 1928-11-01. The 1928 Kingdom Act adopted the inter-war European template: marriage between a Yugoslav woman and a foreign man automatically extinguished her Yugoslav citizenship by operation of law (sometimes called the "loss-by-marriage" or "dependent-nationality" rule), and conversely conferred Yugoslav citizenship on a foreign woman marrying a Yugoslav man. This template was widespread across European nationality acts of the 1920s-1930s era — Slovenia's territorial predecessor framework (the Kingdom-of-SHS and later Kingdom-of-Yugoslavia regime) was no exception.
