Unlike refugee-status (governed by ZMZ-1 — Zakon o mednarodni zaščiti — with a structured refugee-status-determination procedure including formal application, interview, decision, and appeal), Slovenia has no dedicated statutory Statelessness-Determination Procedure (SDP). Statelessness recognition operates through ad hoc administrative determination drawing on:
- ZTuj-2 framework — residence-permit and identity-document regimes for non-EU nationals; the upstream administrative-law track within which statelessness recognition is operationally embedded.
- UNHCR mandate documentation — UNHCR statelessness determinations and refugee determinations are not statutorily required but are highly persuasive evidence in MNZ practice.
- Consular non-recognition correspondence from the applicant's putative state(s) of nationality — direct documentary evidence that no State recognises the applicant as a national.
- Documentary statelessness records — historic State records (where available) and contemporary identity-document records.
- 1954 Convention Article 1(1) definition as the operative legal test.
The European Network on Statelessness (ENS) has repeatedly flagged the absence of a dedicated SDP statute as a structural gap in Slovenian law. Legal basis
Zakon o državljanstvu Republike Slovenije (ZDRS), Article 12 — additional subsections covering several derived sub-pathways including the stateless-person subsection.
