Article 11 of Legea 21/1991 (R) is Romania's restoration corridor — the statutory channel through which persons who lost Romanian citizenship for reasons not attributable to them (din motive neimputabile lor) or whose citizenship was removed against their will (le-a fost ridicata fara voia lor), together with their descendants up to and including the third degree (pana la gradul III) — i.e. children, grandchildren, and great-grandchildren — may have Romanian citizenship granted or reacquired, with the possibility of retaining their existing foreign citizenship and with domicile either established in Romania or maintained abroad ( Art 11(1) as amended L14/2025 pct 7). This is the signature route for the country because, in practice, the overwhelming bulk of these applications come from the descendants of those who held Romanian citizenship on the territories Romania lost in the 1940 cessions — Bessarabia, Northern Bukovina, the Herta region, and the Cadrilater (AS-11). The eligibility key is the ancestor's prior Romanian citizenship and its involuntary loss plus a documented descent chain — NOT ethnicity. The ANC's own 2024 activity synthesis confirms Art 11 dossiers vastly outnumber Art 10 ones (1,761 vs 291 dossier-lists processed in 2024), making this the dominant reacquisition stream. Critically, Art 11 omits the Art 8(1)(a) residence condition and the Art 8(1)(d) lawful-means condition, which is what gives the corridor its no-residence, diaspora-friendly character.

The statutory document framework sits in Art 13-16 of Legea 21/1991 (R), with Art 16 (mod. ELIGIBLE under Art 11(1) at grade III. Citizenship may be granted/reacquired with retention of foreign citizenship and domicile maintained abroad; vests on oath taken before the head of the RO diplomatic mission/consular office (Art 20(14)).
Art 11 reaches descendants pana la gradul III (great-grandchildren) where the ancestral loss was involuntary (1940 cession is the paradigm). Conditions Art 8(1) lit. b),c),e) are met; lit. a) residence and lit. d) means are NOT required. As a never-citizen descendant under 65, the applicant must prove Romanian language at B1 (Art 15^1(4)) — satisfied here. Subject to the discretionary Art 12(3) any-doubt-to-rejection standard.

NOT ELIGIBLE under Art 11 on the great-great-grandparent link (degree exceeds gradul III). Eligibility would require a qualifying ancestor within grade III, or a closer involuntary-loss ancestor.
Art 11 caps descendant reach at the third degree (great-grandchildren). A great-great-grandparent link is grade IV and falls outside both Art 11 (grade III) and Art 10 (grade II) (degree trap). Language and conduct are irrelevant once the degree cap is exceeded. The route does not extend by analogy.

Art 15^1(5) exempts (a) persons who were themselves Romanian citizens reacquiring under Art 10/11, and (b) persons aged 65+ at filing under Art 10/11 (AS-6). This applicant qualifies on both limbs, so the missing B1 certificate is not a bar. Involuntary loss in his own person fits Art 11's 'fara voia lor' trigger. Still subject to Art 8(1) lit. b),c),e) and Art 12(3).

REJECTION expected. Although the degree (grade III) and language are satisfied, Art 11 incorporates Art 8(1) lit. e) (good conduct / no disqualifying conviction); failure of any single condition triggers the Art 12(3) any-doubt-to-rejection rule.
Art 11 expressly requires Art 8(1) lit. b),c),e). A disqualifying conviction defeats lit. e). Art 12(3) provides that grant/reacquisition may be ordered only when ALL conditions are certain; any doubt about any one leads to rejection. A rejection order would be challengeable within 15 days before the Tribunalul Bucuresti, recurs to Curtea de Apel Bucuresti, no ICCJ.
