Who qualifies

§4/A(2)(a) — Limited/no legal capacity: a person judicially determined to have limited legal capacity (korlátozottan cselekvőképes) in citizenship matters or to be incapacitated (cselekvőképtelen) under Hungarian civil law (Ptk.) is exempt. Court order or equivalent documentation of the status required at filing. Reflects that a person without legal capacity cannot meaningfully be expected to satisfy the exam standard.

Documentation required by exemption ground: (a) legal-capacity: court order establishing limited/no legal capacity in citizenship matters; (b) Hungarian-language qualification: diploma/certificate from Hungarian-language institution with certified translation if foreign; (c) age 60: date-of-birth documentation already in naturalisation application (no separate exemption document required); (d) health inability: specialist physician opinion confirming permanent and irreversible nature of condition (with certified translation if foreign).

Documents

The §4/A(2) exemptions are evidenced by track-specific proof: the §4/A(2)(b) educational-qualification exemption requires documentation of a qualification (oklevél/bizonyítvány) obtained at a Hungarian-language-of-instruction institution (magyar tannyelvű intézmény); the health-based exemption requires medical certification of a lasting, irreversible inability to sit the exam; and the incapacity/limited-capacity exemption is shown by guardianship/capacity documentation. Each is annexed to the honosítási kérelem and assessed by the citizenship-matters organ before the ministerial proposal.

How to apply

Exemption claim is asserted within the naturalisation application on the prescribed form, with supporting documentation. The citizenship-matters organ (állampolgársági ügyekben eljáró szerv / Budapest Főváros Kormányhivatala — NOT OIF) reviews the exemption claim as part of the overall §4 assessment. If exemption is accepted: no exam required; other §4(1)/(2)/(4) conditions still apply. If exemption is rejected: applicant must sit the §4/A exam at the Kormányhivatal board.

Fees & cost

No separate fee for asserting a §4/A(2) exam exemption. The naturalisation application is illetékmentes (fee-free) since 2021-01-01. Medical documentation for §4/A(2)(d) must be obtained at the applicant's own cost; certified translation of foreign medical documents is also the applicant's responsibility.

Legal basis

§4/A(2) operative since 2001-07-01. Age exemption threshold: 60 per current consolidated text (hatály 2025.XII.23) — the 65 figure in earlier versions is superseded. Exemptions are open and unmodified as of 2026-05-31. The four-ground structure has been stable since 2001 insertion.

Exemption review: citizenship-matters organ / Budapest Főváros Kormányhivatala (BFKH) per 125/1993 §13/B — NOT OIF. Statutory basis: §4/A(2) a)–d), Act LV/1993. Implementing detail: 119/2005. (VI. 28.) Korm. rendelet (exam rules, from which exemptions derogate).

Exceptions & edge cases

The age-based exemption under §4/A(2) attaches to applicants who have completed their sixtieth year (hatvanadik életév) by the date of filing — NOT sixty-five, which is a superseded figure that must not be carried forward. The threshold is assessed at submission, so an applicant turning sixty after filing does not retroactively gain the exemption; conversely a minor below the age of capacity is exempt under the incapacity limb (§4/A(2)(a)), not the age limb.
