Decisions EXCLUDED from review by the Art 12 reservation: grant or refusal of naturalisation (honosítás) under §4(1)/(2)/(2a)/(3)/(3a)/(4)/(7); re-naturalisation (visszahonosítás) under §5; exceptional grant/condition-exemption under §6. The Presidential grant/refusal — which is a discretionary act under Act LV §6(1)–(2) — generates no reviewable administrative act. The minister's internal proposal is an executive communication, not itself challengeable.
Requirements
Practical implication for applicants: there is no judicial or administrative remedy if the President declines to grant citizenship, even where all documented eligibility criteria under §4(1)/§4(3)/§4(3a) etc. are formally met. The grant remains a discretionary Presidential act. Qualified legal advice can improve application quality and documentation completeness, but cannot substitute for or compel the Presidential grant. This is the defining limitation of the Hungarian naturalisation system compared to rights-based citizenship frameworks.
Legal basis
ECN Art 12 reservation operative 2002-03-01 to present. Additional declaration deposited 2010-12-14 (EIF 2011-01-01) extends Art 22(b) scope — does not affect Art 12 reservation. Act LV §9 withdrawal review (Fővárosi Törvényszék) pre-dates ECN EIF (operative from 1993-10-01) and is unaffected by the reservation. Kúria suspension review (annul-only): operative 2025-06-30 (Act LXIV/2025 §7). The Art 12 reservation itself has not been modified or withdrawn as of 2026-05-31.

Exceptions & edge cases
The ECN Art 12 non-reviewability is confined to the acquisition GRANT/REFUSAL; it does NOT extend to adverse loss decisions. Withdrawal for fraud under §9 (HU-XCT-02) is judicially reviewable at the Fővárosi Törvényszék, and the 2025 suspension regime under §§9/A–9/E (HU-XCT-03) carries a Kúria review within 30 days (45 if classified data). Suspension is therefore reviewable even though the naturalisation grant is not — and suspension is a time-limited loss (felfüggesztés, max 10 years), NOT a deprivation, so the Alaptörvény G) cikk (3) anti-deprivation guarantee is unaffected by either the Art 12 reservation or the suspension regime.
