Who qualifies

A Hungarian citizen may renounce under §8 only if ALL FOUR cumulative conditions are met: (1) holds a foreign nationality OR makes probable (valószínűsíti) that he will acquire one; (2) has no registered place of residence (bejelentett lakóhely) in Hungary (settled abroad); (3) has no pending Hungarian criminal proceeding and no unserved Hungarian criminal sentence; (4) has no outstanding Hungarian public/tax debt (köztartozás).

Requirements

Evidentiary requirements: a renunciation declaration (lemondó nyilatkozat) addressed to the President; proof of a foreign nationality held OR documentary evidence making probable imminent acquisition; evidence of no registered HU residence (settled-abroad status); confirmations of no pending HU criminal matter/unserved sentence and no HU public debt. Foreign-language documents require certified Hungarian translation.

How to apply

Personal scope: the renunciation may, on the statutory representative's declaration, EXTEND to a minor child, provided the child's non-statelessness is secured (the child holds or is acquiring a foreign nationality). This family-unit extension is confirmed at the moderate interpretive tier in consular guidance.

Timeline

Renunciation takes effect on the date of / specified in the President's deed; it is NOT retroactive. There is no statutory maximum processing timeline in the primary text for renunciation; in practice the declaration is examined by the citizenship organ and submitted to the President. The 'effective-on-foreign-acquisition' conditional-deed mechanics (Tier 2/3) rest partly on consular practice rather than verbatim §8 text.

Fees & cost

The citizenship procedure is ILLETÉKMENTES (fee-free). First-instance administrative procedures became illetékmentes from 2021-01-01 (kormany.hu), and the Itv. (1990. évi XCIII. törvény) Melléklet XV. cím citizenship-fee items were repealed (2017. évi II. törvény onward). Only consular translation fees may apply. The historic 'HUF 133,400' figure is SUPERSEDED and never applied to renunciation (P1 correction).

Legal basis

Renunciation of Hungarian citizenship (lemondás) is governed by 1993. évi LV. törvény §8 — a voluntary, applicant-initiated termination mode within Chapter II (A magyar állampolgárság megszűnése). It is a declaration addressed to the President of the Republic (köztársasági elnök) and is the only termination mode the citizen himself triggers (withdrawal §9 and suspension §§9/A–9/E are State-initiated). Competent authority

Preparing organ: the citizenship-matters organ (állampolgársági ügyekben eljáró szerv) — operationally Budapest Főváros Kormányhivatala (BFKH) per 125/1993 §13/B — examines the declaration and prepares the decision. This is NOT OIF (which handles immigration/asylum + Guest Investor residence only). Deciding authority: the President of the Republic issues the renunciation deed (okirat), the same Presidential architecture as the §6 grant applied to termination.

Exceptions & edge cases

Edge cases: (a) Two-State deadlock — declarant abroad whose target State requires prior HU renunciation: resolved via the 'valószínűsíti' limb (conditional/effective-on-acquisition deed). (b) Minor child without independent foreign nationality: renunciation cannot proceed for the child (non-statelessness floor). (c) Declarant with HU registered residence: ineligible (must be settled abroad). (d) Declarant with pending HU criminal proceeding or HU public debt: barred until cleared.
